All terms of the contract between the Company and Purchaser are contained within this document and no variation of this contract or any term thereof shall have effect, unless such variation shall be in writing and signed by a Director of the Company. This document is a complete record and all liability for any representations whether oral, in writing and all guarantees other conditions or warranties whether expressed or implied are hereby excluded.

Property of the Product shall remain with the Company until all monies due from the Purchaser to the Company have been paid in full and the Purchaser shall take good and proper care of the Product pending payment of the installation of the Product.

Upon completion of the installation of the Product the Purchaser is entitled to the Company’s official written guarantee provided that the contract price has been paid in accordance with clause 6.

Any dates relating to the delivery and installation of the Product are given as an estimate only. The Company will endeavour to commence and complete works by the dates given but shall not be liable for any delay or consequential loss incurred by the Purchaser whether or not the cause is beyond the Company’s control and time shall not be of the essence.

The Purchaser agrees to permit or provide access for the Company, its servants and workmen at all reasonable times for the purpose of carrying out the work as specified and to make available all usual services i.e. water and electricity and undertakes that the premises shall be safe for the carrying out of the installation of the Product by the Company’s servants and workmen.

Our representative is authorised to accept cash or cheque with this order. Our installer is authorised to accept payment on completion of the installation. On completion of the installation of the Product or the supply of goods specified overleaf the balance payable under the contract shall be immediately paid to the Company. Payment must be in cash or by way of cheque or Money Order payable to the Company and crossed A/c Payee Only. The Purchaser shall not be entitled to withhold payment by reason of any alleged minor defects. If payment is not made within 14 days of the due date in accordance with this condition the Company has the right to demand interest on the outstanding monies at the rate of 2% per annum above the current bank base rate.

The Company guarantees for a period of ten years the fitting and the white and woodgrain upvc materials incorporated in the installation. All hardware, upvc panels and ancillaries and rainwater goods carry the manufacturer’s guarantee which will be honoured by the Company. Claims for surface damage, blemishes etc. must be made within one week of installation.

Although upvc may need only the occasional wipe down with warm soapy water, it is necessary that all FRICTION STAYS, LOCKING MECHANISMS and HANDLES will require oiling to avoid stiffness of control and rust oxidisation. While the Company uses the finest materials available for its hardware as their subsequent maintenance cannot be maintained by the Company, these are guaranteed for a period of 12 months.

The type of individual parts of double glazing and their arrangement shall in absence of any special arrangement detailed in the contract be determined by the Company. The Company excludes liability for optical effects attributable to natural phenomena.

Only glass from British suppliers of the highest reputation will be used in the Company’s double glazing units but no guarantee is given that any glass used is perfect. The efficiency of sealed units is guaranteed for a period of ten years from the date of delivery to the customer.

Although double glazed units normally reduce condensation of glass, there can be variations in different types of property and therefore no guarantee of this can be given.

The guarantee is not transferrable.

All reasonable care will be taken but the Company shall not be under any responsibility whatsoever to damage to internal or external decoration caused by the installation. Neither will the Company be held responsible for re-fitting blinds, shades, curtains or curtain rails, pelmets, alarm contact points, telephone cables etc.

The Company cannot accept responsibility for structural settlement or movement of brickwork over openings which we do not have a correctly fitted lintel spanning the brickwork opening.

The Company accepts no responsibility for resulting damage from structural or inherent defects of any kind in the property.

The contract price will not include the repair or replacement of any decayed or defective wood discovered during survey or installation, unless such work is specified in the schedule overleaf. Such work will be quoted for separately.

You are advised to ensure that any work covered by this order is permitted by relevant planning laws and Building Regulations.

All conservatory and porch measurements are outside brick sizes.

Cancellation:

a) In the event that the Purchaser signs this contract away from the Company’s premises, he shall have the right of cancellation within 14 days of the receipt of a true copy of this contract signed by both parties. Should the Purchaser wish to cancel within the aforesaid period the Purchaser should complete the paragraph below and return the contract to Head Office.

on cancellation as aforesaid the Purchaser shall be entitled to a return in full of any deposit paid less expenses incurred by the Company.

 

b) Save as herein before provided this agreement shall not be, subject to further cancellation by the Purchaser.

The Company reserves the right to cancel if in the professional opinion of the Company surveyor it is in the Company’s interests to do so.

The Company reserves the right to alter, modify or change the specification of its products without prior notice to the Purchaser in line with the Company’s policy of continuous improvements to its products.
